Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and DevSutes, operated by Jesse Suter ("DevSutes," "we," "us," or "our"), governing your access to and use of our websites, map applications, and related services (collectively, the "Services"). By accessing or using the Services, or by creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. The Services
DevSutes provides GPS maps, scavenger hunts, leaderboards, and related tools for agritourism venues and their visitors. We may add, change, or discontinue features at any time.
2. Accounts
To use certain features you must create an account and provide accurate information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an operator account.
3. Acceptable use
You agree not to:
- Use the Services in violation of any law or the rights of others;
- Attempt to access data, accounts, or systems you are not authorized to access;
- Interfere with, disrupt, or overload the Services, or attempt to circumvent security or rate limits;
- Scrape, harvest, or bulk-export personal information of other users;
- Upload unlawful, infringing, or harmful content.
4. Subscriptions and payment
Paid features are billed through our payment processor, Stripe, on the terms presented at purchase. Unless stated otherwise, fees are non-refundable except as required by law. You authorize us and Stripe to charge your payment method for applicable fees.
5. User and visitor content
Venue operators are responsible for the maps, points of interest, and other content they create, and for their handling of any visitor information (including leaderboard entries) they receive through the Services. Visitors are responsible for the display names and other information they submit. You grant DevSutes a limited license to host and display submitted content as needed to operate the Services.
6. Intellectual property
The Services, including software, design, and DevSutes trademarks, are owned by DevSutes or its licensors and are protected by law. Except for the rights expressly granted here, we reserve all rights.
7. Third-party services
The Services rely on third-party providers (for example, map imagery, analytics, payments, and email). Your use of those features may be subject to the providers' own terms, and we are not responsible for third-party services.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Map locations and navigation are provided for convenience and may be inaccurate; do not rely on them for safety-critical purposes.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DEVSUTES AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless DevSutes from claims arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
11. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or to protect the Services. You may stop using the Services at any time.
12. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Franklin County, Ohio for any dispute not subject to arbitration or small-claims court.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance.
